1. Objet
Les présentes conditions ont pour objet de définir les conditions d'utilisation du site tom-florek.fr ainsi que les modalités de vente des prestations proposées par Tom Florek.
2. Propriété intellectuelle
Tous les contenus présents sur ce site, y compris mais sans s'y limiter, les photographies, vidéos, logos, textes, graphismes, sont protégés par des droits d'auteur et autres droits de propriété intellectuelle.
Toute reproduction, diffusion, ou utilisation de ces contenus sans l'autorisation expresse de Tom Florek est interdite.
3. Services proposés
Tom Florek propose des prestations de photographie et de vidéographie pour des particuliers et des professionnels, incluant mais ne se limitant pas à :
Shootings personnels et professionnels
Reportages photo/vidéo pour événements
Films et clips vidéo
Création de contenu pour les réseaux sociaux
Les prestations sont décrites sur les différentes pages de ce site. Toute demande spécifique pourra faire l'objet d'une proposition personnalisée.
4. Commandes et devis
Toutes les demandes de prestation doivent faire l'objet d'une prise de contact via le formulaire de contact, par téléphone ou par e-mail. Après discussion et définition des besoins, un devis détaillé sera envoyé, comprenant les services proposés, les tarifs, ainsi que les modalités de paiement.
5. Tarifs
Les prix des prestations sont indiqués dans les devis et sont exprimés en euros, hors taxes (TVA non applicable, exonération de TVA). Ils peuvent varier en fonction des besoins spécifiques du client. Les tarifs peuvent être modifiés à tout moment sans préavis.
6. Modalités de paiement
Un acompte de 25% est demandé à la signature du contrat ou de l'accord. Le solde est dû à la livraison des photos et vidéos. Les paiements peuvent être effectués par virement bancaire, carte de crédit ou tout autre mode de paiement convenu.
7. Annulation et reports
En cas d'annulation ou de report de la prestation par le client, un préavis de 3 jours est requis. L'acompte versé ne sera pas remboursé en cas d'annulation à moins de 2 jours de la date de la prestation.
Si la prestation est annulée par Tom Florek, un remboursement total des paiements déjà effectués sera effectué.
8. Livraison des photos et vidéos
Les photos et vidéos sont livrées sous format numérique dans un délai de 21 jours suivant la prestation. Des copies physiques peuvent être fournies sur demande, moyennant un supplément.
9. Responsabilité
Tom Florek met tout en œuvre pour réaliser des prestations de qualité. Toutefois, il ne pourra être tenu responsable des éventuels désagréments dus à des facteurs extérieurs comme des conditions météorologiques, des incidents techniques ou des comportements inappropriés des participants à la prestation.
10. Confidentialité
Toutes les informations personnelles collectées sur ce site sont utilisées uniquement dans le cadre de la réalisation des prestations et ne seront pas transmises à des tiers sans le consentement préalable des utilisateurs, sauf dans le cas où cela est nécessaire pour la bonne exécution du service.
11. Droit applicable et litiges
Les présentes conditions générales sont régies par le droit français. En cas de litige, le tribunal compétent sera celui de Compiègne, sauf si une autre juridiction est spécifiquement désignée.
12. Modification des CGU
Tom Florek se réserve le droit de modifier ou de mettre à jour les présentes conditions générales à tout moment. Les modifications prendront effet dès leur publication sur le site tom-florek.fr.
